Here are three practical ways recruiters can immediately improve profit margins using legal strategy:
1. Stop Writing Off Unpaid Fees
Unpaid invoices aren’t just frustrating – they’re eroding your margins. We regularly see recruiters delay legal escalation for months, then write off fees they legally could’ve recovered.
One client came to us after chasing a £12k invoice for six months. The client ghosted them, citing vague terms. We enforced it under the Contract (Rights of Third Parties) Act and secured payment within 10 days. That’s £12k back into the margin.
Tip: Use solicitor-led fee chasers early. Letters from lawyers have weight and you’ll collect faster without burning the relationship.
2️. Don’t Let Clients Rewrite Your Terms
How many times have you “agreed to review” a client’s terms just to keep the deal moving? That’s where margin damage starts. Dodgy clauses like extended rebate periods, watered-down payment triggers, or IP grabs can cost thousands down the line.
A retained search firm we work with nearly agreed to 90-day payment terms hidden in a 14-page contract. We flagged it, renegotiated to 30 days, and updated their master terms to prevent future issues.
Tip: Have your own terms and stick to them. If you’re reviewing client terms, get legal eyes on them before agreeing. Prevention is cheaper than cure.
3. Don’t Let Backdoor Hires Slip Through
Backdoor hires are more common than you think and they’re one of the biggest margin leaks we see. We’ve helped agencies recover fees ranging from £3k to £75k after candidates were quietly hired behind their backs.
A tech recruiter recently flagged a suspicion. We investigated and found the candidate hired through a partner company. Fee recovered: £18,250.
Tip: Regularly monitor for backdoor activity. If you suspect one, act fast. The longer you leave it, the harder it is to enforce.
