There is a good article from the REC on the subject of age discrimination here. It answers some of the more common questions about the new legislation including:
- Can we still ask for a candidate’s Date of Birth on our application form?
- Can we give Clients a candidate’s Date of Birth on a CV or on request?
- Can we ask for or provide the client with a candidate’s employment or education dates?
- Can we, for example ask for 15 years experience in the telecoms industry when we advertise for candidates?
- Who is liable if the agency is taken to a tribunal over age discrimination for the actions of a recruitment consultant, the individual or the said agency?
- What should I do if I receive a request from a client that I believe to be discriminatory?
- What is the position with regard to candidates that we place abroad?
Everywhere I look questions are being asked about the law so I can only assume that advice is still requried. There are a couple of topics on the discussion board on the subject: Age Discimination in Advertising and solicitor for the new age legislation
